Pitfalls confronting lawyers who utilize social media, and the ethical obligations of lawyers to keep abreast of emerging technology will be discussed. The “I Love HOT MOMS” case -- in which a lawyer suffered a six-figure monetary sanction and five-year license suspension for his role in attempted spoliation of social media evidence – will be carefully analyzed from an ethics perspective. The case will then serve as a focal point for discussion of several other cutting edge ethical issues which have recently been the subject of ethics opinions and commentary. In addition, the ethical obligations of lawyers to learn about and use new and emerging technologies, including social media and online research tools, will be examined. Recent rule changes and case law placing the burden on attorneys to know about and use technology or be in breach of ethical obligations, including the duty to perform competently, will be highlighted.
